Terms of Service

These Terms of Service ("Terms") govern your use of the PianoCloud™ mobile application and DCM-1™ Piano Climate Monitor device ("Service") operated by PianoCloud Corporation ("we," "our," or "us").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not use our Service.

2. Description of Service

PianoCloud provides:

• Real-time environmental monitoring for pianos via DCM-1 devices
• Fault detection and alerting (power, water, sensor pad issues)
• Mobile app for device management and monitoring
• Cloud-based data storage and analysis
• Push notifications for critical events

3. User Accounts

Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must be at least 13 years old to create an account
• One account per user; no sharing accounts

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Device Usage

DCM-1 Device

• Devices must be used according to provided instructions
• Devices are for monitoring purposes only, not safety-critical applications
• You are responsible for proper installation and maintenance
• Warranty terms are provided with device purchase or subscription

Network Requirements

• Devices require WiFi connectivity to function
• You are responsible for your internet service costs
• We are not liable for connectivity issues outside our control

5. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Experience unexpected downtime
• Modify or discontinue features with reasonable notice

6. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to such processing.

7. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Attempt to hack, reverse engineer, or disrupt the Service
• Use the Service for any illegal or unauthorized purpose
• Transmit viruses or malicious code
• Impersonate others or provide false information
• Interfere with other users' use of the Service

8. Intellectual Property

All content, trademarks, and intellectual property in the Service are owned by PianoCloud Corporation You may not:

• Copy, modify, or distribute our intellectual property
• Use our trademarks without permission
• Create derivative works

9. Limitation of Liability

• We are NOT liable for device failures, false alarms, or missed alerts
• We are NOT responsible for damage to pianos or property
• Our liability is limited to the amount you paid for the Service in the past 12 months
• We are NOT liable for indirect, incidental, or consequential damages

10. Indemnification

You agree to indemnify and hold harmless PianoCloud Corporation from any claims arising from your use of the Service or violation of these Terms.

11. Subscription and Billing

Free Service

Basic monitoring features are currently provided free of charge.

Future Premium Features

We reserve the right to introduce paid premium features with advance notice. Existing basic features will remain free.

12. Termination

You may terminate your account at any time through the app settings. Upon termination:

• Your data will be deleted within 30 days
• Your devices will stop reporting data
• You will lose access to historical data

13. Changes to Terms

We may modify these Terms at any time. Significant changes will be notified via:

• Email to your registered address
• In-app notification
• Notice on this page with updated "Last Updated" date

Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions.

15. Dispute Resolution

Any disputes will be resolved through binding arbitration in accordance with the American Arbitration Association rules.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
